UPDATE:  SPCC Compliance Deadlines Extended to 2006

On July 17, 2002, the United States Environmental Protection Agency (USEPA) finalized amendments to its Oil Pollution Prevention regulations found at 40 Code of Federal Regulations (CFR) 112. Specifically, these amendments resulted in long overdue changes in applicability of the standards and to Spill Prevention, Control, and Countermeasure (SPCC) planning requirements.

Originally, existing plans were to be updated by August 2003 and implemented by February 2004. In light of partially settled litigation (see American Petroleum Institute v. Leavitt et al., No. 1; 102CV02247 PLF and consolidated cases [D.D.C. filed November 14, 2002]), the USEPA published a final rule notice in the August 11, 2004 issue of the Federal Register extending the compliance deadlines to February 17, 2006 for amendment of existing plans and August 18, 2006 for implementation of amended SPCC plans.
